About these terms

These terms apply to all services provided by xKemp Solutions, a web design and development agency based in Bedfordview, Germiston, South Africa. By engaging our services or submitting an enquiry through this website you agree to these terms.

Our services

xKemp Solutions provides the following services:

• Custom website design and development
• E-commerce store development
• Website hosting and maintenance
• Search engine optimisation (SEO)

All websites are custom built from scratch. We do not use templates. The scope of each project is agreed upon in writing before work begins.

Free demo

We offer a free demo website built within 48 hours of receiving your brief. The demo is a real, working website built with your brand and content. You only pay once you have reviewed the demo and are happy to proceed. If you are not satisfied, you are under no obligation to pay. xKemp Solutions reserves the right to limit free demo requests at its discretion.

Payment

Payment terms are agreed upon before each project begins. Generally:

• No payment is required until you have approved your demo
• Once approved, a deposit may be required before final delivery
• Final payment is due before the website goes live
• All prices are quoted in South African Rand (ZAR) and are inclusive of VAT where applicable

Client responsibilities

To deliver your project on time we require:

• Timely provision of content, images, logos and other assets
• Prompt feedback and approvals at each stage of the project
• Accurate business information for use on your website

Delays caused by the client may affect the agreed delivery timeline. xKemp Solutions is not liable for delays caused by missing content or late feedback.

Intellectual property

Upon full payment, you own the website design and content we create for you. xKemp Solutions retains the right to display your completed project in our portfolio unless you request otherwise in writing. We retain ownership of any reusable code components, frameworks or internal tools used during development.

Hosting and maintenance

If you purchase a hosting or maintenance package from xKemp Solutions, the terms of that package will be outlined in a separate agreement. Hosting fees are billed monthly or annually as agreed. xKemp Solutions may suspend hosting for non-payment after 14 days written notice.

Limitation of liability

xKemp Solutions is not liable for any loss of business, revenue, data or profits arising from the use or unavailability of your website. Our total liability in any circumstance is limited to the amount paid by the client for the specific service in question.

Governing law

These terms are governed by the laws of the Republic of South Africa. Any disputes will be resolved in the courts of Gauteng, South Africa.
